Book with us and your funds are 100% secure. On Track safaris is a member of the Travel Trust Association, which is a trade association of Travel Agents, Tour Operators and Travel Organisers, that operate trust accounts, in order to provide financial protection for the consumer. The TTA lays down strict guidelines on how customer funds may be handled and each member must adhere to these guidelines. Every TTA member puts customer’s funds into a designated trust account, which is supervised by an independent trustee. Your funds are held in this account and may not be released unless you receive your holiday or your funds are released to another company that becomes responsible and provides for your financial protection.

Booking Terms and Conditions

Interpretation of Terms
Company shall mean On Track Safaris Ltd (Company Number 9428597) and any other tour or safari operator, carrier.
Safari shall mean the package, tour, safari, accommodation, travel advertised, conducted or provided by the Company.
Client shall mean the client of the Company and each person on whose behalf a safari is booked.
Group shall mean two or more persons who have been booked together for a safari and may join with other group or groups.

General payment information
Your invoice will be in Pounds Sterling.
For electronic bank transfers, full banking details are shown on the invoice. Your bank will advise you of the applicable charges.
We accept VISA and MasterCard debit/credit cards at no extra charge via a secure on-line portal.

You are required to read and accept this Acknowledgment of Risk which hereby forms part of your contract with us.

1.0 General

1.1 Travel advice
For up-to-date travel advice from the UK government, visit www.gov.uk/foreign-travel-advice and https://travelaware.campaign.gov.uk. We recommend that you consult these websites before booking in order to make an informed decision about your chosen destination, and again before departure.

1.2 Insurance
At the point of booking, we recommend that you ensure that you have a specialist travel insurance policy which covers you for medical treatment, cancellation and lost luggage while away and also includes specific cover for Covid-19 related issues and incidents which may affect your travel arrangements [and travelling to a destination subject to a FCDO advisory against travel]. It remains your responsibility to read and understand the insurance policy and ensure that it is suitable and adequate for your particular needs. Please read your policy details carefully and take them with you on holiday. If you choose to travel without adequate insurance cover, we will not be liable for any losses suffered by you in respect of which insurance cover would otherwise have been available.

1.3 Please note that we will have no liability for any refunds, compensation, costs, expenses or other losses of any kind incurred by you (including, where applicable, the cost of medical treatment), in the following circumstances:
(a) If you, or anyone in your booking party, test positive for Covid-19, or are notified or otherwise become aware that you have, or suspect you may have, come into close contact with someone who has tested positive for Covid-19 (or where they otherwise suspect they may have Covid-19) and have to self-isolate for a period of time.
If this happens within 14 days of your departure date, you must contact us immediately as you may no longer be able to travel. We will offer you the following options where possible and subject to availability:
a. Postponing your holiday to a later date. We will notify you of any impact on the price the postponement may have (please note that you may have to pay full cancellation charges on some elements of your holiday, such as the flight, as well any increase in cost imposed by suppliers);
b. If not everyone on the booking is affected, you will have the right to transfer your place on the holiday to another person nominated by you, subject always to compliance with the requirements within our booking conditions;
c. Cancelling your booking, in which case we will impose our standard cancellation charges as at the date of cancellation by you. You may be able to claim these costs back from your travel insurance – please check your policy wording.
If this happens whilst you are on your holiday, please notify us immediately and we will provide such reasonable assistance as we can in the circumstances. However, we will not be responsible for covering the cost of any curtailment of your holiday, missed transport arrangements, additional accommodation required, or other associated costs incurred by you. Your travel insurance may cover some of these costs for you – please check the policy wording.

(b) You fail any tests, checks or other measures imposed by a supplier, airline, port or airport, border control authority or other government body or local authority or fail to submit for testing or assessment when requested to do so, and as such you are denied boarding, entry to the destination, access to the travel services or you are otherwise unable to proceed with your holiday, or any part of the holiday, or you are required to self-isolate within the destination. Your travel insurance may cover some of these costs for you – please check the policy wording.

1.4 Your holiday experience
You acknowledge that the suppliers providing your holiday will need to comply with national and/or local guidance and requirements relating to Covid-19 and have implemented certain measures as a result. This will likely include specific requirements regarding personal protective equipment, such as use of face-masks by staff (and you may be required to wear a face-mask as well), social distancing, maximum number restrictions on the use of certain facilities, PCR or other tests. We do not expect these measures to have a significant impact on your enjoyment of your holiday and all measures will be taken with the purpose of securing your safety and those around you.

1.5 Events Beyond Our Control
In these booking conditions, “Events Beyond Our Control” means a situation which is beyond our or the supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Such situations are likely to include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, flood, epidemics and pandemics, fire, airport, port or airspace closures, restrictions or congestion, flight or entry restrictions imposed by any regulatory authority or other third party, an FCDO advisory against travel to a particular destination and any other government restrictions on travel. Except where otherwise stated in these booking conditions, we have no liability including for compensation, costs and expenses in such situations.

1.6 FLIGHT CANCELLATION
If you pay the Company (which is received on behalf of the Airline or Travel Provider) for a flight booking, we will act as agent of such Airline or Travel Provider. Your contract for the flight is between you and the relevant Airline or Travel Provider.
You should ensure that you have adequate cancellation insurance that covers you for cancellation of flights by the relevant Airline or Travel Provider.
You understand and agree that:
Airlines ultimately control their schedules, and they may change or cancel your flight for a variety of reasons (for example, mechanical problems or adverse weather, etc.). Whenever the airline gives us information about a change or cancellation to your itinerary, we will pass it on to you and help you assess your options. You should always check the scheduled departure time of your flight before travel.
The Company shall not be held liable for any schedule changes.
Airlines control seating and we do not guarantee the availability of specific seats, even when pre-booked
If you book a return flight and do not use the outward flight, the airline may cancel the return flight without refund.
For special or charter flights, the airline, the flight schedule, the aircraft type, the itinerary and possible stops are given as an indication only. These specifics may be subject to change even after confirmation - please check the relevant Rules and Restrictions before booking
Some airlines impose extra charges for meals, luggage and preferred seat selection, etc. Unless we provide such optional services for booking through our Service then any reference about these extra optional services and related charges shown through our Service is for information only and may be updated by airlines at any time. Where we provide the option for you to book such extras through our Service, then the price of such optional extras will be displayed to you and after selection by you, added to your price
You must follow the relevant Rules and Restrictions on the carriage of children. Children older than 2 on the return date must have a return ticket at a child fare for both the outbound and inbound flights. You will not be eligible for a refund of any seat charges incurred during travel if you do not comply. Children aged under 2 will not be allocated their own seat unless a child fare is booked for them. Unaccompanied children under 14 will only be allowed to fly in line with the relevant Rules and Restrictions
The carriage of hazardous materials aboard aircraft in your luggage or on you is generally forbidden.

2.0 Standard Terms and Conditions

2.1 Introduction
These are the terms of business on which the company will provide services to any person who undertakes a safari with the company. The booking of a safari constitutes the Client's acceptance of these terms as the sole contractual terms that apply as between Company and each person on whose behalf a safari is booked.
In the case of services booked through an agent, it is the agent's responsibility to the client to ensure that the client is made aware of these terms, since their client will be bound by them, and that the client complies with them insofar as they impose obligations on the client; these terms constitute a collateral contract between the agent and the company to that effect.
The Company does not employ agents to solicit business from clients on its own behalf. Intermediaries through whom safaris/services are booked for clients are agents of the client.
Reservation charges
A 40% non-refundable deposit is required at the time of booking with the balance to be paid at least 60 days before the original scheduled arrival date, unless advised otherwise at the time of booking. Payments dates will be defined on your invoice at the time of booking. For last minute bookings conditions will change.

2.2 Cancellation charge
For cancellations received by us in writing after full payment has been received, the following cancellation charges apply:
• Up to 61 days prior to arrival: 40% of total cost
• 60 to 45 days prior to arrival: 75% of total cost
• Between 44 to 21 days prior to arrival: 90% of total cost
• 20 days or less, or no show: 100% of total cost.

2.3 Cancellation by the Company
The company reserves the right to cancel your safari or accommodation in any circumstances, for any reason and at any time before full payment has been received. In these circumstances, we will return to you all monies paid. The company reserves the right to cancel your booking at any time due to circumstances amounting to force majeure, which include war, riot, civil strife, outbreak of serious disease at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, terrorist activity, natural disaster, fire, adverse weather conditions, restrictions or congestion and flight restrictions imposed by any regulatory or other third party, power failure, technical problems with transport, flood, drought, government active, and other unusual and unforeseen circumstances outside of our or the supplier(s) concerned control. In circumstances amounting to force majeure, no compensation will be payable.

2.4 Amendments to your booking by the Company
It is unlikely that we will have to make any changes to your booking, although we reserve the right to make changes at any time. If there are any changes, most of these will be minor and we will advise you of these in writing at the earliest possible date.

2.5 What is included/excluded
All quotations you receive from us will detail what is included and what is excluded in order that you have all the information you require. Please contact us if you have not received this information.

2.6 General Terms and Conditions
These are the agency terms on which the Company with associated website address of www.ontracksafaris.co.uk and www.ontracksafaris.com will make a booking for your holiday. For all bookings the company will act as the agent for the Principal who provides your accommodation or safari. As an agent, the Company accept no responsibility for the acts or omissions of the Principal. The Companies Terms of Business are governed by English Law and the jurisdiction of the English Courts. Please note that in ALL cases the lead name on the reservation must be 18 (eighteen) years or over at the time of booking. The lead name will be in contract with the supplier and will be responsible for the information provided for all members of the party this includes the correct spelling of names, title, age, passport and visa information and ensuring that all party members travel with full valid travel insurance. All travel products featured on this website are subject to availability. Each passenger should travel with adequate insurance cover. Such insurance will ensure that you are covered against unforeseen cancellation charges, medical costs incurred whilst away from home (subject to approval), personal liability claims, loss of money etc. Please seek your Doctors advice for specific information relating to your journey. The prices shown on this website are valid at the time of input, however we reserve the right to change our prices or other details at any time. Prices may go up or down. We will send you an invoice confirming your payment details and will contact you if there are any discrepancies in the pricing.
The Company can provide general information about the passport and visa requirements for your trip. Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Entry requirements for the destination are the customers own responsibility. The Company accept no responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements, or if entry requirements for the destination prevent you from travelling.
Standard terms and conditions at most safari lodges require guests to sign an indemnity form (liability release in the unlikely case of loss, injury or damages while on safari).

2.9 Indemnity
The Client acknowledges awareness of the safari itinerary and confirms that each person on whose behalf they are booking is medically fit, in good physical and mental health and is able to embark on the safari.
Any client with a pre-existing medical condition or illness must declare the true nature of such conditions to the Company before the commencement of the safari. Any failure to declare may result in cancellation of his/her booking.
The client hereby acknowledges, confirms and records that the risks inherent in safari travel and associated safari activities are understood by each person on whose behalf a safari is booked and record that these booking conditions have been read and understood and agree to the terms and conditions.

The Company shall be under no liability to the client for any claim which may arise in respect of or in connection with the Safari and the Client hereby renounces for him/herself, members of his group and dependants all claims against the Company for compensation for injury, death, damage or loss whether sustained in travel, on a vehicle, embarking or disembarking from a vehicle or in a game reserve, hotel or lodge or elsewhere or as a result of delays or otherwise, caused directly or indirectly to him/her or his/her belongings, members of his group and his/her dependants or to persons who except for these conditions might have been entitled to make a claim.

The client acknowledges that the services arranged by the Company, whether in civilised or remote areas by plane, vehicle, train, dug-out canoe, canoe, boat, horseback, other conveyance or by foot, contains inherent risks of injury, illness, death, or loss and damage to property, which may be caused by forces of nature, accidents, wild or dangerous animals, negligence of others, and other causes known or unknown.
That there will not always be protection in the form of fences, building and vehicles in which to take cover and that exposure to dangerous animals such as elephant, lion, hyena, buffalo, rhinoceros, leopard, cheetah, hippo, buck, warthog, bush pig, wildebeest, crocodile, tiger, gorilla, baboon and monkey as well as venomous snakes, spiders, insects and plants and other natural hazards that may occur whilst on safari and that rivers and dams may contain bilharzias and sickness may result upon entry or consumption of such waters. Swimming, bathing, drinking and washing must be taken in accordance with the clients’ medical practitioners’ advice.
That the group is aware of the hazards and distribution of malaria and the potential dangers of exposure to sun - directly or indirectly - and that serious sunburn may result from unprotected exposure.
The client acknowledges that such risks may be present at any time before, during or after the safari arranged by the Company and that medical services and facilities may not be readily available during the safari.

The Client indemnifies the Company (including all its agents, representatives, members, associates, organisers, employers and employees or person appointed by the Company to perform services in connection with the safari), against all responsibility or liability whatsoever for any accident or bodily injury or damage to Client property whilst on Safari.

The client undertakes and agrees that he/she will, at all times, comply to a reasonable code of conduct during the safari and will not in any way constitute a nuisance to the other persons on safari.

The client agrees not to allege the unenforceability of this Agreement or part thereof. In the event of any competent authority finding that any portion of this Agreement is unenforceable, the remaining portion shall remain in full force and effect. The client agrees that the aforegoing obligation shall be binding.

The carriage handling or keeping of any baggage and or other goods of the Client will be at the sole risk of the Client or its owner and the Company shall not be liable for any loss or damage of whatsoever nature and howsoever caused.

Whilst the Company will use its best endeavours to ensure that all anticipated accommodation, food, drinks and other such services are available as planned, there shall be no claim of any nature whatsoever against the Company for a refund either in whole or in part or of any other claim of any nature whatsoever including consequential damages as a consequence of any transport, accommodation or other facility attached to the Safari not being available.

The Client undertakes to hold harmless and free the company from any and all claims and liability of whatsoever cause or nature which may arise as a result of a claim and/or action being made against it by any travel agent, booking agent or other agent relating in any way to a claim or action that the Client or his/her spouse, common-law wife/husband, children (whether minor or adult) or any other dependant of mine may make. The decision of the tour leader employed by the Company will be final on all matters. The Company shall not be responsible for, or liable for, any client who commits an illegal or unlawful act in any countries visited. The client may in such circumstances be excluded from the tour without a refund. If the Company considers a client unsuitable for a tour, it may at its sole discretion decline to carry this client any further. If any client causes inconvenience or annoyance to other passengers, The Company may in its sole discretion decline to carry the client further without any refund whatsoever.
The client hereby agrees to adhere to all instructions given by the Company (whether verbally, on notices in vehicles, published in leaflets or other documentation during the safari including:
To remain seated in vehicles whilst in motion
Not to leave designated campsites and picnic spots and to remain within the confines of other areas specified or pointed by the Company.
To take all safety measures to avoid fire hazards
